Minimum wage framework for employees with disability employed in open employment  


Employees with a disability who are able to earn full adult, junior or training wages as the effects of their disability do not impact on their productive capacity

Covered by a Pay Scale

Employees with disability (as defined by the Workplace Relations Act 1996) who are able to earn full adult, junior or trainee wages as the effects of their disability do not impact on their productive capacity covered by a Pay Scale (ie. award covered before 27 March 2006) have their statutory minimum wages set and adjusted by that Pay Scale.

· ie. the full adult, junior or training wage specified by the Pay Scale is paid to employees.

The Commission’s general Wage-Setting Decisions adjust these minimum rates of pay.

Not covered by a Pay Scale
Employees with disability (as defined by the Workplace Relations Act 1996) are exempt from the standard Federal Minimum Wage. Employees with disability who are able to earn full adult, junior or training wages as the effects of their disability do not impact on their productive capacity not covered by a Pay Scale have their statutory minimum wages set and adjusted by:

  • Special FMW No.1 – Employees with a disability who are able to earn full adult, junior or trainees wages as the effects of their disability do not impact on their productive capacity (Special FMW No. 1).

This special Federal Minimum Wage is set and adjusted to equal the standard Federal Minimum Wage.

Employees with disability who are unable to perform the range of duties to the competence level required because of the effects of a disability on their productive capacity

Covered by a Pay Scale that includes Supported Wage System (SWS) provisions
Employees with disability who are unable to perform the range of duties to the competence level required because of the effects of disability on their productive capacity covered by a Pay Scale that includes the SWS have their statutory minimum wages set and adjusted by the relevant Pay Scale.

The Commission’s general Wage-Setting Decisions adjust these minimum rates of pay.

Covered by a Pay Scale that does not include Supported Wage System (SWS) provisions
Employees with disability who are unable to perform the range of duties to the competence level required because of the effects of disability on their productive capacity covered by a Pay Scale that does not include the SWS have their statutory minimum wages set and adjusted by the:

  • Special Supported Wage System (Employees with a Disability) Australian Pay and Classification Scale (Supported Wage System Pay Scale)

Not covered by a Pay Scale
Employees with disability who are unable to perform the range of duties to the competence level required because of the effects of disability on their productive capacity and who are not covered by a Pay Scale Not covered by Pay Scales (award free prior 27 March 2006) have their statutory minimum wages set and adjusted by:

  • Special FMW No. 2 – Employees with a disability who are unable to perform the range of duties to the competence level required because of the effects of a disability on their productive capacity – and are not currently covered by a Pay Scale. (Special FMW No. 2)

This instrument sets out a mechanism for determining pro rata wages using the Supported Wage System.
