AFPC Decisions for employees with disability in Australian Disability Enterprises
The Commission has made a number of wage-setting decisions for employees in Australian Disability Enterprises. It has created and adjusted the Special Business Services Pay Scale as well as adjusted the Pay Scale derived from the Liquor, Hospitality and Miscellaneous Union Supported Employment Services Award 2005 (LHMU Pay Scale). The following is a chronological history of the Commission’s decisions in relation to these two Pay Scales.

Commission decision extracts that created and adjust the Special Business Services Pay Scale
Extract of Wage-Setting Decision 1/2006
This decision created the Special Business Services Pay Scale, adjusting wages to give effect the 2006 general wage increase. The Special Business Services Pay Scale included all wage assessment tools included in the LHMU Pay Scale.
Wage-Setting Decision 1/2007
This decision varied the new special Pay Scale to correct a numbering error at paragraph 4.5.
Wage-Setting Decision 3/2007
This decision varied the Special Business Services Pay Scale to flow-on the Commission’s general Wage-Setting Decision 2007.
This decision also created a process for consideration of additional Wage Assessmet tools.
Extract of Wage-Setting Decision 8/2007
The new special Pay Scale determined by Wage-Setting Decision 1/2006 was consolidated by the Special Business Services Pay Scale determined by Wage-Setting Decision 8/2007.
Wage-Setting Decision No.1/2008
This decision varied the Special Business Services Pay Scale to inlcude a further 9 wage assessment tools.
Wage-Setting Decision 2/2008
This decision varied the Special Business Services Pay Scale to flow-on the Commission’s general Wage-Setting Decision 2008.
Wage-Setting Decision 1/2009
This decision was to remove the Paraplegic-Quadriplegic Association of WA (Inc) Wage Assessment Tool from the Special Business Services Pay Scale from 1 June 2009.
New special Pay Scale – Employees with a disability who are unable to perform the range of duties to the competence level required because of the effects of their disability on their productive capacity- are employed in business services and are not currently covered by a Pay Scale (Special Business Services Pay Scale)[1]

Extract of Wage-Setting Decision 1/2006
This decision varied the preserved LHMU Pay Scale to flow-on the general 2006 wage increase and inserted a further 11 wage assessment tools for use by employers.
Wage-Setting Decision 3/2007
This decision varied the LHMU Pay Scale to flow-on the Commission’s general Wage-Setting Decision 2007.
Wage-Setting Decision 1/2008
This decision varied the LHMU Pay Scale to include a further 8 wage assessment tools.
Wage-Setting Decision 2/2008
This decision varied the LHMU Pay Scale to flow-on the Commission’s general Wage-Setting Decision 2008.
[1] At the time of the creation of this instrument, Australian Disability Enterprises were referred to as Business Services. The instrument continues to cover applicable employees in what are now referred to as Australian Disability Enterprises.
